DISPUTE.-
"Claim of Mr. J. L. Walker, Section Foreman, Tennessee Railroad Company, that he should have been placed in accordance with Article 1 of the
agreement, effective October 1, 1935, in place of a junior man on vacancy
as section foreman which Mr. Walker made proper application for."
FINDINGS.-The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment Board
ex parts by complainant party.
No hearing thereon has been had and under date of February 25, 1937, the
complainant party addressed a formal communication to the Secretary of the
Third Division withdrawing the case.
AWARD
Case dismissed.
