"Claim of R. O. Banks, regular assigned messenger and extra check clerk, for wage losses sustained on June B, 1936, account management failing and refusing to call him to fill a vacancy on position of check clerk, due to the absence of B. Z. Herndon, regular incumbent of that position."
FINDINGS.-The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That this dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant.
Hearing on this case was had, and. concluded on May 17, 1937. Subsequently, but before the Board had made an award, the complainant formally requested permission to withdraw the case from further consideration, to which request the respondent states no objection is offered; accordingly
