PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on Norfolk Southern Railroad, that extra employees on telegraphers seniority roster, Northern District, who were avallable for assignment to the vacant position of operator-clerk in the Kinston freight office from October 9, 1932 until October 9, 1935 inclusive, shall be paid a day's pay for each day they were available to work the position but not assigned."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.


No hearing thereon has been held and under date of October 8, 1937, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of the case from further consideration, which request is hereby granted.




Claim dismissed.
