STATEMENT OF CLAIM: "Conductor Leath requests that deduction be made from the seniority rating of Conductor L. W. Crouch, in accordance with the rule then in effect, for all time spent in a promoted position so that he (Lenth) will be shown in his correct position ahead of Crouch on the seniority roster."
The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party.
No hearing thereon has been had and under date of December 1, 1937, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
