STATEMENT OF CLAIM: "Claim of L. Horton for pay for one day, November 26th, 1936, at the rate of $102.75 per month, and pay for two days, November 27th and 28th, 1936, at the rate of $122.50 per month, account failure of the carrier to notify him he had been displaced by senior employe from his regularly assigned position of Clerk at Fairfield, Iowa."

FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.


No hearing thereon has been bad, and under date of January 21, 1938, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
