STATEMENT OF CLAIM: "Claim of the System Board of Adjustment, B. R. C., that the Carrier has violated and is continuing to violate the Clerks' Agreement by assigning clerical work incident and necessary to the making of daily yard checks between South Gate and Long Beach to employes not covered by said Agreement, and further, failing and refusing to assign such work to employes holding seniority rights thereto under the Clerks' Agreement; also claim of employes for all wage losses sustained as a result of such agreement violations retroactive to Oct. 1, 1936."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon has been held and concluded. Under date of January 28, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
