STATEMENT OF CLAIM: "Claim of Vernon Oliver, Bill Glastane, Otto Lueth, Sidney Kelly, R. E. Watson, Victor Schummers, Ed Wallace, Glenn Griffin, Truman Shawley, Monroe Mathis, John Smith, Alvin Jantz, L. A. Perkins, Thomas Castello, Olan Chenaalt, Henry Martin, Herman Martin, George Martin, J. W. Kasper, Rhinhardt Schmidt, Clarence Bentz, Arthur Crandle, Bert odges, Otto Stuffy, Morris Rhodel, Teodore Palmatore, Glenn Grantz, Cecil Unruh, Jack Stuffy, J. A. Middletown, Ralph David, Austin Chenault, Tom Biggs, Glen Likins, Edward Ratzlaff, Memmo Wedel, Ray Grantz, George Warsters, Kenneth Webster, Jack Rauch, and Harvey Wedel extra gang laborers employed in steel gang on the El Paso-Amarillo Division, dismissed from the service on account of declining to board in the commissary outfit, for reimbursement for time lost."


FINDINGS: THE Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.


No hearing thereon has been had, and under date of March 3, 1938, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
