STATEMENT OF CLAIM: "Claim for reimbursement of monetary loss sustained by all employes affected account discontinuing position of Night Yard Clerk rate $109.50, Belleville, Kans., between dates October 15th, 1936, and June 15th, 1937, and claim for reinstatement of position of Night Baggageman, rate $105.00 per month, Belleville, Kans., and reimbursement of employes for all monetary loss sustained account discontinuing this position effective June 15th, 1937."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. Under date of Apr. 21, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
