STATEMENT OF CLAIM: "Conductor T. K. Davis, New York District, contends that the discipline of 60 days assessed against him December 22, 1937, later reduced to 32 days, is unjust and should be eliminated from his record; that he should be immediately returned to his assignment and be reimbursed for loss of wages sustained on account of actual removal from service."
The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.
No hearing thereon has been had and under date of May 12th, 1938, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
