PARTIES TO DISPUTE:







STATEMENT OF CLAIM: "Claim of the General Committee of the Order of Railroad Telegraphers on Missouri Pacific Railroad that, A. F. Stoval was improperly removed from his regularly assigned position of car distributor at Little Rock, Ark., on December 1, 1937, when the position was declared discontinued by the carrier and the duties and responsibilities of the position transferred to the division trainmaster not under Telegraphers' Agreement; that Stoval shall be restored to the position and paid for any monetary loss in wages sustained by reason of his improper removal; and that any extra men sustaining monetary loss since December 1, 1937 by reason of Stoval being retired to the extra board shall be likewise reimbursed."


FINDINGS: The Third Division of the Adjustment Board after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has ,jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. On June 17, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
