STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on The Atchison, Topeka & Santa Fe Railway, that the carrier violated the Telegraphers' Agreement by temporarily employing additional persons on a part-time basis December 18th to 24th, 1936, inclusive, to take the place of and perform the work regularly assigned to the third trick telegrapher at the passenger station at Great Bend, Kansas."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon has been held and concluded. On June 20, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
