STATEMENT OF CLAIM:
"Claim of the System Committee of the
Brotherhood of Railway Clerks that:
(1) The Carrier has violated and continues to violate the working and wage agreements between it and the Brotherhood, when it
fails and refuses to classify, rate, bulletin and assign work
of
handling
express 'shipments at Memphis, Tenn., in accordance with the rules
and rates incorporated in said agreements, and,
(2) The Carrier be required to restore such work to the scope
and operations of said agreements and that positions properly classified and rated in accordance with properly established and aa-eedupon basic rates of pay be bulletined and assigned in accordance with
the agreement rules."
FINDINGS:
The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment Board
ex parts by complainant party.
No hearing has been had, and, under date of July 6, 1938, the complainant party addressed a formal communication to the Secretary of the
Third Division withdrawing this case.
AWARD
Claim dismissed.
