STATEMENT OF CLAIM:
"Claim of the System Committee of the
Brotherhood that--
(1) The work of driving or operating a gasoline tractor used to
haul or otherwise handle express shipments or property of the Carrier
at Charlotte, N. C., is work subject to the scope and operations of the
working and wage agreements between the Carrier and the Brotherhood, and
(2) That the Carrier shall now be required to classify, rate, bulletin and assign such work in accordance with said agreements as
requested and claimed in letter of General Chairman Daughtrey to
General Agent Small, dated April 29, 1937."
FINDINGS:
The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment Board
ex parte by complainant party.
No hearing has been had, and, under date of July 6, 1938, the complainant party addressed a formal communication to the Secretary of the
Third Division withdrawing this case.
AWARD
Claim dismissed.
