PARTIES TO DISPUTE:





THE CHICAGO, ROCK ISLAND AND GULF RAILWAYS

STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers, Chicago, Rock Island and Pacific By., that the incumbent of the supervisory agency at Ponca City, Oklahoma (a position not included in the Telegraphers' Agreement), is regularly transmitting and receiving messages of records; that such work is covered by the scope rule of said Agreement and that this position shall be included within the Telegraphers' Agreement, or, at the carrier's discretion, an employe carried on the telegraphers official seniority roster be assigned to perform the work in question."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. Under date of August 10, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
