STATEMENT OF CLAIM: "(1) Claim of the System Committee of
the Brotherhood that the assignment of clerical work, hereinafter described, at Hempstead, N, Y., October 22, 1937, was in violation of Regulations 3, 5 and Memorandum of Understanding governing the handling of
extra employes,
"(2) Claim of the System Committee of the Brotherhood that Extra
Clerk V. N. Rocca, should be compensated for eight (8) hours pay, at the
rate of $121.20 per month, account of junior employe performing extra
work at Hempstead, N. Y., October 22, 1937."
FINDINGS: The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party.
No hearing thereon has been had, and under date of October 4, 1938,
the complainant party addressed a formal communication to the Secretary
of the Third Division withdrawing this case.
AWARD
Case dismissed.
