STATEMENT OF CLAIM: "The particular question herein involved is the unwarranted dismissal from service, by the Frisco Dining Car Department, of David A. Merriweather, (Waiter), operating out of St. Louis, Missouri."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party.


No hearing has been had, and under date of October 6, 1938, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Claim dismissed.
