RAILWAY SYSTEM
STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on lie Atchison, Topeka & Santa Fe Railway, that the work of transmitting of messages and reports of record by telephone is work covered by telegraphers' agreement and shall be performed by employes under said agreement, and the carrier is violating the agreement in requiring or permitting pumpers not under telegraphers' agreement, at Darby, Ibis, Pica, Haviland, Topock and at other points on the system to transmit messages and reports of record daily by the use of the telephone."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon has been held and concluded. On October 26, 1938, the parties jointly requested withdrawal of the case from further consideration by the Division, which request is hereby granted.
