THE ATCHISON, TOPEKA, AND SANTA FE RAILWAY

COMPANY-(Coast Lines)


STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on the Atchison, Topeka & Santa Fe Railway, that the handling of train orders is work covered by the Telegraphers' Agreement and shall be performed by employes under the said agreement and train dispatchers, and that the carrier in requiring or permitting employes not under the agreement to handle train orders at Essex and Denby on December 17th, and 18th, 1936, which was foreseen and not an emergency, violated the Telegraphers' Agreement."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board jointly by the parties.


No hearing thereon has been held and under date of October 26 1938, the parties jointly addressed a formal communication to the Secretary, of the Third Division requesting withdrawal of the case from further consideration, which request is hereby granted.




Claim dismissed.
