SOUTHERN PACIFIC COMPANY-(Pacific Lines)
STATEMENT OF CLAIM: "Claim of the System Committee of the
Brotherhood:
"1. That the Carrier has violated and continues to violate agreement rules when it works elevator operators and janitors in
its General Office Building on Sundays at pro rata rates and
blanks their positions on assigned rest days; and
"2. That M. Kopyn, A. V. Nelson, W. H. Briggs or other employes so worked and paid shall be reimbursed for wage losses
sustained represented by differences between amounts paid
at pro rata rates on Sundays and amounts due at punitive
rates retroactive to November 22, 1936."
FINDINGS: The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment Board
ex parte by complainant party.
No hearing thereon has been had, and under date of October 24, 1938,
the complainant party addressed a formal communication to the Secretary
of the Third Division withdrawing this case.
AWARD
Case dismissed.
