PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Conductors J. W. Davies, A. P. Hall, A. J. Grimmig, W. E. Ayer, J. G. Lang, S. E. Huntley, C. H. Conway, C. H. Kincade, P. F. Kaufman, R. E. Marland, R. R. Coffey, R. L. Watson, C. T. MCAdams, J. E. McCarthy and A. Walsh, New York District, claim that Conductor W. C. Kennamer was used in extra service in January, 1938, which deprived the extra board of 11 hours and 20 minutes pay, and that pay for this service should be pro-rated among the extra conductors."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party.


No hearing thereon has been had and under date of November 25 1938 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
