BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: "Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the position which the Carrier classifies as PorterTrucker at Mercedes, Texas should be classified as General Clerk with a rate of pay of $5.25 per day from June 1, 1937 to August 1, 1937 and at a rate of $5.65 per day from August 1, 1937 until proper classification and rate of pay is applied, and that all employes who have been or may be affected by the Carrier's action in this case be compensated for all loss sustained."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon was held November 7, 1933, but not concluded. Under date of November 15, 1938, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
