HOUSTON BELT & TERMINAL RAILWAY COMPANY

STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the carrier is violating the freight handlers' agreement by permitting freight to be handled by persons not covered by the Freight Handlers' agreement and that such work as set out in Rule 1 of the agreement must be performed by employes holding rights and working under the freight handlers' agreement."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party.


No hearing thereon has been had, and under date of February 21, 1939, the complainant party addressed a ormal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
