BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: "Claim of the System Board of Adjustment of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad Company, that the carrier violated the Clerks' Agreement,
"(1) When on April 4, 1938, it abolished the position of Yard Clerk, assigned hours 8:00 A. M. to 12:00 Noon-1:00 P. M. to 5:00 P. M., six days per week, rate $4.99 per day at Hope, Ark., and failed to give the occupant, F. J. Mason reasonable notice of intent to abolish the position;
(2) When on April 4, 1938, it abolished the position of General Clerk, assigned hours 8:00 A. M. to 12:00 Noon-1:00 P. M. to 5:00 P. M., six days per week, rate $5.54 per day at Prescott, Ark., and failed to give the occupant V. D. Daniel reasonable notice of intent to abolish the position;
"That Clerk B. L. Kanady shall be compensated for wage loss sustained April 5 to April 9, 1938, both dates inclusive, at the rate of $5.54 per day, amount $27.70, and
"That Clerk, V. D. Daniel shall be compensated for wage loss sustained April 5 to April 9, 1938, both dates inclusive, at the rate of $5.54 per day, amount $27.70." FINDINGS: The Third Division of the Adjustment Board finds that:
The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.
No hearing thereon has been had, and under date of March 3, 1939, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
