BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that the Carrier violated agreement rules when (1) On January 3rd and 4th, 1938, it worked and paid C. Beck, W. Pontery and J. McGrogan, Freight Handlers, less than a minimum of eight (8) hours each day, and (2) on January 12, 1938, it worked and paid F. W. Stahl and W. Pontery, Freight Handlers, less than a minimum of eight (8) hours; and that said employes shall be compensated for wage losses suffered as a result of such actions."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon has been held and concluded. Under date of March 10, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
