PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "1. Claim of the System Committee of the Brotherhood that T. E. Luzzi, J. Jjo rmane J. Frasciello, E. Werner, T. Sweeney and J. Shinnors, Freight Hlers, be paid a minimum of eight (8) hours per day, six (6) days per week in accordance with the provisions of rules 20 and 24, at the prevailing rates of pay, retroactive to February 28, 1938.


"2. Claim of the System Committee of the Brotherhood that the positions, held by above employes, be advertised and awarded in accordance with the provisions of rules 2, 3 and 12, of existing agreement and that senior affected employes, entitled to said positions, be compensated for any monetary losses, retroactive to February 28, 1938."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectivelv carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. Under dates of March 13 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
