PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Grievance is hereby made charging mistreatment, the result of unfair allocation of lines on the Southern Pacific Rock Island Golden State Route. The withdrawal of the train known as the 'Apache' from service on February 13th and the consequent loss of this assignment to the Los Angeles District has left the Chicago Central District operating all of the service over these lines. We contend that the train known as the 'Californian' should be allocated to the Los Angeles District in order to effect an equitable allocation, taking into consideration all of the factors upon which such allocations are made. The Los Angeles District conductors, parties to this dispute, are Ilot Johnson, A. H. Brunner, E, Shaw, A. L. Montgomery, C. H. Hek, H. G. McEwan, R. Richards, J. T. Ellis, C. B. Coaa, J. A. Bryant, H. J. Needham, W. 0. Tripp, L. D. Wallace, E. L. Jordan, F. R. Hill, C. R. Alfring, W. L. Godfrey, A. F. Diggins."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. Under date of March 10, and 13, the employes and the carrier, respectively, advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
