PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers, Southern Pacific Company, Pacific Lines, that Telegrapher Martin Lindsey was improperly displaced from his regularly assigned position of agent at Watsonville Junction, Calif., on May 9th, 1932, that he be compensated for all net wage loss sustained by him between the date of his removal from the position of agent at Watsonville Junction, May 9th, 1932 until his return to Watsonville Junction as agent-telegrapher on August 1st, 1937 and that he be compensated at the rate of 50 per mile for the use of his automobile in working positions available to him during the period of time May 9th, 1932 to August 1st, 1937."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon has been held and concluded. Under date of March 6, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
