PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Conductor W. T. Lewis, Washington District, claims pay for seven days during which he was held out of service, as it was claimed, for his failure to get up when called to adjust matters relative to an attendant having taken liberties with a woman passenger on Car Mississiquoia, Line 6359, April 22, 1938."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.


No hearing thereon has been had, and under date of April 26, 1939, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
