STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


"(1) The Carrier violated agreement rules when it nominally abolished position of Clerk, Desk No. 2, rate $4.48 per day, effective November 30, 1934, and created a position classified as Station Helper, rate $2.23 per day, effective December 1st, 1934, to perform the duties of incumbent of clerical position at Lake Crystal, Minnesota, and that


"(2) The Carrier shall be required to reimburse- employes occupying position classified and paid as Station Helper difference between $2.23 and $4.48 per day, for wage losses sustained as a result of said rules violation.


"NOTE: Rates shown above are subject to 400 per day increase granted
in National Wage Agreement of August 4th, 1937."

FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


Hearing thereon was held March 14, 1939, but not concluded. Under date of April 14, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Claim dismissed.
