STATEMENT OF CLAIM: "Claim of the General Committee of the Order of Railroad Telegraphers of the Denver and Rio Grande Western Railroad Company that the rate of 61 cents per hour arbitrarily paid by the carrier in the telegraph offices at Mill Fork and Detour, Utah., which offices were established by bulletin May 1, 1937, was an improper one and that employes who occupied any position in either office shall be compensated at the same hourly rate as paid telegraphers in Soldier Summit, Utah, office during the period Mill Fork and Detour offices were open."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
Hearing thereon was held May 3, 1939, but not concluded. Under date of June 26, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted,
