PARTIES TO DISPUTE:



THE BALTIMORE AND OHIO RAILROAD COMPANY

STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on the Baltimore and Ohio Railroad that the adding to the position of East End Car Distributor at Pittsburgh, Pa., the work of transmitting and receiving of messages and reports of record by the use of the telephone with other offices on the division when that position was moved to Pittsburgh from Connetlsville as result of the consolidation of the Connellsville Division with the Pittsburgh Division on February 14, 1933, brought said position within the scope of the Telegraphers' Agreement as of the date the change took place and certain duties were added, and that same be included in the Telegraphers' Agreement, the incumbent of the position to remain and allowed seniority on the Telegraphers' roster as of the date he first performed the service which brought the position within the scope of said agreement."


FINDINGS; The Third Division of the Adjustment Board finds:

That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934;


That the dispute was certified to the Third Division of the Adjustment Board jointly by the parties; and


That no hearing has been had and under date of July 28, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Case dismissed.
