PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific (Pacific Lines) that, owing to the circumstances under which Agent E. C. Puryear, Carlin, Nevada, is being required to meet Train No. 21 on the loth and 25th of each month, at a time of day outside his regular assigned hours, he shall be allowed a call for each such date beginning February loth, 1938, on which he has met or does meet this train in compliance with standing instructions to do so."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party.


No hearing thereon has been had, and under date of August 14, 1939, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
