PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "For and in behalf of J. E. Broady who was formerly employed by the Pullman Company as an attendant operating out of the District of Washington, D. C. Because the Pullman Company did on February 20, 1939 discharge Attendant Broady, which discharge was unjust and without sufficient reason on alleged charges unproved, and further, for the restoration of J. E. Broady to his former position as an attendant in the Washington, D. C. District with his seniority unimpaired and with pay for all time lost by reason of this unjust and unreasonable discharge."


STATEMENT OF FACTS: Prior to his dismissal, February 20, 1939, J. E. Broady, employed by. the Pullman Company as an attendant, Washington, D. C. District, was assigned to attendant on Line 2900, Southern Railway System, between Washington, D. C. and Atlanta, Ga.


While in service on this assignment in December 1938 and January 1939, Broady was charged with failure to carry out instructions in connection with the handling of commissary supplies, etc.


Hearing was held, following which Broady was formally notified of his discharge.


Appeals were accorded in compliance with the provisions of the agreement effective October 1, 1937.


OPINION OF BOARD: The evidence of record discloses no grounds for disturbing the action of the Carrier.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That the evidence of record discloses no grounds for disturbing the action of the Carrier.
