PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that-


"(a) The carrier violated and continues to violate the rules of the working agreement between the above named parties dated August 1, 1929, by failing and refusing to apply the provisions thereof to certain of its employes in groups 2 and 3, rule 1, Article I, as stipulated in letters of General Chairman J. L. Webster, dated July 9, 1938, addressed separately to Superintendent N. Johnson, Mechanical Superintendent E. M. Smith, and Purchasing Agent W, F. Wright, and later appealed to Vice President C. G. Lunday and President C. P. Couch, and that


"(b) All employes in groups 2 and 3, rule 1 of the agreement shall be treated with, worked and compensated in accordance with rules of said agreement retroactive to July 9, 1938."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of November 8, 1939, the parties addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
