PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that--


"(a) The Carrier violated the Clerk's agreement when on December 26th, 1938 it discontinued the position of caller-clerk at Pittsburg, Kansas, and thereafter assigned a substantial portion of the duties of said position to employes not covered by Clerk's agreement; namely, Trainmaster's clerk, Local Agent, the Chief Clerk to the Local Agent, Secretary and Assistant Secretary to the Superintendent. Also some work assigned to operator.


"(b) That position of caller-clerk at Pittsburg, Kansas, rate $4.31 per day, be re-established and all employes affected by action of Carrier be reimbursed for all wage losses suffered, retroactive to December 26th, 1938."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of October 31, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Case dismissed.
