PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that-


"(a) The Carrier violated the current agreement when it permitted and required Cashier at Hope, Arkansas, to work in excess of eight consecutive hours, exclusive of the meal period, per day, without paying for such service at overtime rate, and


"(b) The Carrier shall now be required to compensate Cashier at Hope, Arkansas, for all wage loss sustained as a result of Carrier's violation of our agreement, from September 1st, 1934, up to and including September 22nd, 1937:'


FINDINGS: The Third Division of the Adjustment Board finds:

That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act as approved June 21, 1934;


That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing has been had and under date of November 16, 1939, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
