PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that-


"(a) The Carrier has violated and continues to violate rules of agreement between the parties, effective August 1st, 1929, by having allegedly abolished position of 'Steno-Clerk,' rate of pay $126.15 per month, at Minden, La. on May 15, 1931, and the transferring of the entire work to a re-established position of 'Chief Clerk,' which position is not covered by Clerks' Agreement and


"(b) The employe affected, E . J. Hanson, be restored to seniority roster and compensated for all monetary loss sustained as result of this violation."


FINDINGS: The Third Division of the Adjustment Board finds:

That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing has been had and under date of November 16, 1939, the complainant party addressed a formal communication to the Secretary, of the Third Division withdrawing this case.




Case dismissed.
