BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:


"1. The position of Station Helper at San Diego, Texas be classified as a clerk with a rate of $135.00 per month retroactive to September 15, 1938; and


"2. That all employes involved in or affected by the improper classification and rate be compensated for all monetary loss sustained, including proper overtime at the rate of time and one-half because of assigned hours."


FINDINGS: The Third Division of the Adjustment Board finds that:

The dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That no hearing thereon has been had, and under date of November 20, 1939, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
