PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES


CHICAGO AND NORTH WESTERN RAILWAY COMPANY

STATEMENT OF CLAIM: "Claim of System Committee of the Brotherhood of Railway Clerks that Mr. H. Hartford shall now be assigned to position No. 144-7, Ticket Accountant, rate $6.65 per day in the office of Division Accountant, Chicago, Illinois and reimbursed for all monetary losses suffered by him retroactive to April 2, 1938 as a result of carrier having failed and refused to assign Mr. Hartford to said position in accordance with his seniority rights and rank."


.FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held and concluded. Under date of November 21 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Case dismissed.
