BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: "Claim of System Committee of the Brotherhood of Railway Clerks that Miss Olive Haefele, General Clerk, Statistical Department, Ravenswood, Illinois now be assigned to position of General Clerk No. 271-6, rate $6.45 per day and reimbursed for all monetary losses suffered retroactive to April 2, 1938 as a result of carrier having failed and refused to assign Miss Haefele to said position in accordance with her seniority rank and rights."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the carrier and the employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That hearing thereon has been held and concluded. Under date of November 21, 1939, the parties jointly advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
