THE KANSAS CITY SOUTHERN RAILWAY COMPANY

STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that-R. L. Cox, Bill Clerk (rate $6.49 per day) at Shreveport, La., Local Freight Office be paid for three (3) hours at time and onehalf rate for every Sunday and holiday from February 16th, 1939 to September 30th, 1939-both dates inclusive-, account failure to call said Bill Clerk to do the rating and billing of freight on these Sundays and holidays and used a lower rated employe to do the necessary work on these days."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party.


That no hearing thereon has been had and under date of July 3, 1940 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
