PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers, Southern Pacific Company, Pacific Lines, that telegrapher displaced from his position at Watsonville Junction on August 1st, 1937 as a result of placing Martin Lindsey on position of agenttelegrapher on that date, be restored to the position of first telegrapher at Watsonville Junction and compensated for all monetary loss sustained as result of such removal from the position of first telegrapher-clerk at Watsonville Junction; further,


"That any telegrapher displaced from his regularly assigned position as result of first telegrapher-clerk, Watsonville Junction, being improperly displaced from his position through the placing of Martin Lindsey on position of agent-telegrapher at Watsonville Junction, be restored to his respective position and compensated for all monetary loss sustained."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party.


That no hearing thereon has been had and under date of August 8, 1940 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
