PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that Dudley, Franklin, F. H. Rahnie, A. F. Spitzer, H. F. Settle, J. B. Enable and J. V. Tricker were entitled to be paid at time and one-half rate for services performed as Tallymen at Fourth Street Freight Station, Washington, D. C., on Sundays and Holidays during the years 1936 and 1937 as stipulated in joint record and submission of dispute signed by Division Chairman, A. B. Seward and Superintendent E. S. Reed under date of October 7, 1938 and that said employes shall now be paid for wage losses suffered as a result of the Carrier paying for such service at pro rata rates in violation of Regulation 4-A-2."


FINDINGS: The Third Division of the Adjustment Board finds;

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party;


That hearing thereon has been held but not concluded, and under date of December 11, 1940, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
