PARTIES TO DISPUTE:





STATEMENT OF CLAIM: "Conductor W. E. Meyer, Los Angeles District, claims that his seniority rating is not properly shown on the roster for 1940, that he should be shown on said roster ahead of Conductors R. V. Lambert and E. L. Waian, and he asks compensation for all time lost on account of being improperly shown on said roster. The posting of rosters is provided for in Rule 26, Agreement between The Pullman Company and Conductors in the service of The Pullman Company."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party;


That no hearing thereon has been had and under date of December 14, 1940 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
