STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers, Chicago, Rock Island and Pacific Railway, that the carrier violated the terms of the Telegraphers' Agreement by permitting or requiring an employe not under said Agreement to perform the work of the agent at Sayre, Oklahoma, on May 31, 1939, while the agent was absent, by direction of the carrier, attending a staff meeting at El Reno; and that the senior available competent extra employe on the telegraphers' seniority roster be paid a day's pay at the rate of this agency account not called and thus being denied this work to which he was entitled."
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party.
That no hearing thereon has been held and under date of December 23, 1940, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
