BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that John Lawton, John Palumbo, J. L. Brozenic, R. E. Hein, R. C. Williamson, Andrew Burney, Dom. Minotti, Thos. Dunlevy, A. Francis, S. G. Amoroso, A. Morana and W. Piorkowski, Extra list employes, were entitled to and shall now be paid at the rate of time and one-half for services performed on Sundays, July 31, August 7, and August 14, 1938, on positions of Mail Caller, Pittsburgh, Pa. Baggage Room."


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That hearing thereon has been held but not concluded. Under date of January 8, 1941, the petitioner advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.




Case dismissed.
