BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood-


"(1) That the actions of the carrier abolishing Position F-53, Davenport Street Freight Station, Cleveland, Ohio, on Jan. 24 1938 while all of the duties thereof continued to exist, and concurrently therewith assigning said duties to other employes, some of whom were not covered by the Clerks' Agreement and others of whom were receiving lower rates of pay, was improper and in violation of said Clerks' Agreement;


"(2) That said position F-53 shall now be re-established and

"(3) That E. A. Krahn shall be restored to said position and reimbursed for monetary losses sustained as a result of carrier's violation of said Agreement."


FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party.


That no hearing thereon has been held and under date of January 8, 1941, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.




Case dismissed.
