BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that J. H. Donley, D. F. Donley, O. W. Strom, W. F. Delozier, A. Romagnoli, H. M. Hofman, P. T. Maloney, Albert Giososa, W. B. Mallery, J. B. Edelman, L. C. Focht, A. C. Nearhood and A. Dunkel were entitled to be paid at the rate of $5.07 per day for services performed in the Baggage Department, Altoona Passenger Station, December 14th to 24th, 1937, instead of at the rate of forty-five (45) cents per hour, and shall now be paid for wage losses suffered as a result of Carrier's violation of Wage Agreement and Regulations governing Miscellaneous Forces."
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
That hearing thereon has been held but not concluded. Under date of January 8, 1941, the petitioner advised the Secretary of the Third Division of their desire to withdraw it from further consideration by the Division, which request is hereby granted.
