STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that Messenger Frank Plasencia at Laredo, Texas shall be paid a minimum day of eight hours at rate of time and one-half for each Sunday and holiday retroactive to September 15, 1938."
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party.
That no hearing thereon has been held and under date of December 20, 1940, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.
