STATEMENT OF CLAIM: "Claim of the System Board of Adjustment of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes on the Missouri Pacific Railroad, that the Carrier violated and continues to violate the Clerks' Agreement:

"1. When on July 21st, 1940, it required regularly assigned Dupo

    "4.           "NOTE: The employes' language `similarly affected' appearing in specification 4, refers to instances subsequent to July 19th, 1940, where these yard automobile messengers have been required to perform service similar to that involved in these claims and which claims while not specifically mentioned herein have been presented to the Carrier and have been declined."

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party.

That no hearing thereon has been held and under date of December 12, 1940, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case.

                  AWARD

Case dismissed.
